Terms of Internet Membership

Please read this Terms of Use carefully before using the Korean Air Cargo Web Site (the "Web Site"). Access to the Web Site is subject to the terms and conditions set out below. Your use of the Site signifies your acceptance of this Terms Of Use. If you do not agree to comply with this Terms of Use, please do not use the "Web Site"

1. Copyrights

1.1. Unless otherwise indicated, Korean Air Cargo ("We") either own the intellectual property rights in the text, images, multimedia sources and other content that is made available to you on this Web Site (the "Materials"), or have obtained the permission of the owner of the intellectual property to use the Materials on the Web Site.

1.2. We grant you a limited license to display on your computer, print, download, and use the Materials for your own internal business or personal purposes.

1.3. We are not liable for any liability you incur as a result of using this limited license.

1.4. No other use is permitted without our express written permission. Nothing stated or implied herein confers on you any license or right under any copyright of us or any third party.

2. Disclaimer

2.1. Materials provided on the Web Site are provided "as is" without warranty of any kind, either expressed or implied, including without limitation warranties of merchantability, fitness for a particular purpose, and non-infringement. We specifically do not make any warranties or representations as to the accuracy or completeness of any such Materials. We periodically add changes, improve, or update the Materials on this Site without notice. Under no circumstances shall We bee liable for any loss, damage, liability or expense incurred or suffered which is claimed to result from use of this Web Site, including without limitation, any fault, error, omission, interruption or delay with respect thereto. Use of this Web Site is at your sole risk. Under no circumstances, including, but not limited to, negligence, shall we or our affiliates be liable for any direct, indirect, incidental, special or consequential damages, even if we have been advised of the possibility of such damages.

2.2. You specifically acknowledge and agree that we are not liable for any conduct of any user of the Web Site.

2.3. As a condition of use of this Web Site, you agrees to indemnify us and our affiliates from and against any and all actions, claims, losses, damages, liabilities and expenses (including attorneys' fees) arising out of your use of this Site, including without limitation any claims alleging facts that if true would constitute a breach by you of these terms and conditions. If you are dissatisfied with any material on this Web Site or with any of terms and conditions of use of this Web Site, your sole and exclusive remedy is to discontinue using this Web Site.

2.4. Some of the links on the Web Site may lead to resources outside of the Web Site. The linked sites are not under our control and we have not reviewed or investigated in any way the information at such linked sites. We make no representation or warranty as to the contents of any linked site or any link contained in a linked site. We provide these links only as a convenience, and the inclusion of any link does not imply endorsement, representation or warranty by us.

2.5. You should not assume that the Materials are complete or up-to-date. We are not obliged to periodically or otherwise update the Materials, however regular reviews of the Materials for content and relevance will be conducted.

2.6. Communications made through the electronic mail and/or messaging capabilities of the Web Site shall in no way be deemed to constitute legal notice to or from us or any of our employees or representatives. Nothing in this Web Site or any Materials shall be construed, implicitly or explicitly, as containing any investment recommendations. Accordingly, nothing in such Site, or in such Materials, constitutes an offer of or an invitation by or on behalf of Korean Air Cargo to purchase or sell any of the shares or securities of companies mentioned, nor should it be considered as investment advice.

3. e-Customer Service

3.1. This Web Site, provide two kind of information. One is general information page and the other is advanced and customized information page (the "e-Customer Service").

3.2. We may from time to time, in our absolute discretion, provide that e-Customer Service shall be secured so that access shall only be allowed to our registered users in possession of a valid Username and Password.

3.3. Account Information

3.3.1. We can provide that e-Customer Service's Main Username by going through due our internal formalities. Main Username user can generate his company's Subsidiary Username for his own internal business purposes. Main Username's owner is responsible for the managing Subsidiary Username.

3.3.2. You shall ensure that all information provided to us in connection with your registration information including a Username and Password is accurate, and shall notify us in the event of any change. You agree that we shall not be liable for any loss caused as a result of any inaccuracy in the information provided to us.

3.3.3. You agree to keep the Password secure at all times and take steps to prevent unauthorized use of it and your Username. You agree that we shall not be liable for any loss caused as a result of any negligence of managing e-Customer Service's Main or Subsidiary Username casing by you.

3.3.4. You shall not attempt to access any part of the e-Customer Services for which you have not been specifically granted permission and shall inform us if you gain any such access, whether inadvertently or otherwise.

3.3.5. You shall immediately notify us in the event that your Password becomes known to any unauthorized user, or you suspect that your security has been compromised and shall comply with any reasonable directions we make concerning the restoring of security.

3.3.6. We shall have the right to refuse or, at any time to revoke your access to any secured part of the Web Site.

3.3.7. Although we use security systems to protect the Secured e-Customer Services, no server is completely safe from unauthorized access. We are not liable for any breach of security unless caused by our own negligence or willful default.

3.4 You shall only use the e-Customer service for your legitimate business or personal purposes and subject to the conditions herein as well as any other applicable terms and conditions relevant to the service. In particular, but without limitation to the generality of the foregoing:

3.4.1. Any Tracking service may only be used for the purpose of tracking shipments tendered by you for delivery or tendered by others for delivery to you. You warrant that you are in lawful possession of each Air Waybill number you enter into Tracking Service.

3.4.2. The Bookings service, Schedule, and Allotments service may be used for the purpose of booking and reserving shipments. You warrant that you are in lawful possession of each Air Waybill number you enter into the Bookings (including Allotments) service.

3.4.3. Accounting service may be used for the purpose of your company's internal reference only. You have to manage Username for only authorized person. You warrant that you are in lawful possession of each Air Waybill number you enter into the Accounting information service.

3.4.4. The Quality report service may only be used for the purpose of your company's shipment operational statistics reference. You warrant that you are in lawful possession of each Air Waybill number you enter into the Quality report service.

3.4.5. We shall not be liable for any loss caused as a result of any inaccuracy in the information provided to us by you in connection with the use of any e-Customer Services.

3.5. We reserve the absolute right to reject any application for a Username and Password, or any Service we provide without providing any reason for such rejection.

4. Amendments

4.1. We may revise this Terms Of Use and/or introduce additional terms and conditions at any time and from time to time.

4.2. We reserve our exclusive right in our sole discretion to alter, limit or discontinue the Web Site or any of the Materials in any respect.

5. No Waiver

5.1. No act, delay or omission by us shall affect our right, powers and remedies under this Terms Of Use or any further or other exercise of such rights, powers or remedies. The rights and remedies under this Terms Of Use are cumulative and not exclusive of the rights and remedies provided by law.

5.2. No waiver by KE of any provision of this Agreement shall be binding except as set forth in a writing signed by its duly authorized representative.

6. Severance

If any provision of this Terms Of Use is not or ceases to be legally binding and enforceable it will not affect the legality, binding effect or enforceability of any other provision.

7. Access to the Web Site

7.1. We reserve the right to deny in our sole discretion any user access to the Web Site or any portion thereof without notice.

7.2. We shall have no obligation to take the needs of any user into consideration in connection therewith.

8. Privacy

8.1. General 
Our collection of your company and personal information in this case is for the reasons set out below and we aim to process and hold such information on the basis of the guidelines and principles set out in this statement and in our overriding Privacy Policy which applies generally to information held by us. 
 
8.2. The Way of Collection 
We collect your personal information directly by requesting that you fill out the suggested forms and the transaction information through our web service (http://cargo.koreanair.com).
In addition we may also collect information regarding your IP address, browser type, domain name and access time. 
 
8.3. Type of Information 
We request limited necessary information of company and personnel's for being easy to use our website. It depends on the minimum requirements of the services we offered. The categories of company and personnel's information may include your name, company name, company title, company position, company address, company telephone number (including mobile and fax numbers) and company email address.
 
8.4. Our Use of Your Information 
We will process the collected information to provide cargo related services to you in accordance with the purpose of the Website described. In addition, we may use the collected information for our statistical research and analysis for the marketing of our products and services (unless you choose by contacting us at any later date using Letter, e-Mail, Fax, etc..., not to receive any marketing communications). 
 
8.5. Our Disclosure of Your Information 
We value all company and personnel's information received by us and do our best to maintain its privacy. Except as stated below or with your prior consent or as required by law, we will not transfer or disclose your company and personnel's information to any third party:-

8.5.1. Any personnel, agent, adviser, auditor, contractor or service provider who provides services or advice to us in connection with our operations insofar as required to enable us to provide, or assist us in providing, the services you have requested;

8.5.2. Unless you have chosen not to receive marketing communications from us or our marketing communications and operations partners with whom we share information for the purpose of providing you with special offers and information;

8.5.3. Any person under a duty of confidentiality to us

8.5.4. Any person to whom we are required to make disclosure under any law applicable

8.6. Security 
We will use such secured encryption systems as are appropriate for the collection of your personal information over the Internet, based on the type of information being collected. Unfortunately these security measures are not 100% secure and it is possible that others may intercept the information you are sending.

We will also take such steps as are appropriate to ensure the security of that information while it is held by us. This will include Password protection and other electronic security methods as well as physical security methods, where appropriate, to help ensure that the information can only be accessed by our authorized employees, which employees shall be made aware of the terms of this statement and our duties to you under it. 
 
8.7. Data Access and Correction 
You are entitled to access personally identifiable information we hold about you and if applicable to correct or update it. You also have the right to request details of our personal data privacy policy and the type of personal data we hold. We have the right to charge a reasonable fee for processing a data access request.

9. Applicable Law and Jurisdiction 
This Agreement will be interpreted and enforced in accordance with the laws of the Republic of Korea. Any action to enforce this agreement shall be brought in a court of competent jurisdiction located in Seoul, Korea.

Privacy Policy

1. Collecting "PII"
Korean Air may ask homepage members to provide PII for member management, marketing and advertising.

<Required fields> 
- User ID, password, name, IATA code or Account code, agent’s name
- Representative or personal e-mail address, company address (location), company telephone number

<Optional fields> 
- Regional staff's e-mail address 
- Whether or not member will receive e-mail notice

Korean Air collects PII by using the following means.
- Membership or bulletin board on the website, telephone and fax
- Our sales representatives and cargo staffs in all branches

2. Purpose of Collecting "PII"
Korean Air does not use the PII for any purpose other than as stated in this article unless it is required by laws or applicable regulations.

- Member management : User identification, prevention of membership abuse and unlicensed user of service, confirmation of membership registration, regulating membership registration, maintaining record for dispute resolution, customer service and announcement
- Marketing and advertising : New services notice, and promotional events and information

In order to enhance the range of useful information and service to our members, Korean Air has established links to other websites. However, Korean Air would like to recommend users to check and confirm other linked sites’ privacy polices since Korean Air has no direct control over such websites.

3. Terms & Duration of "PII"
Korean Air destroys whole or any part of PII immediately when its purpose has been served as follows.
- Membership Information : Upon the termination of membership 
- Information collected temporarily for survey or event : When applicable survey or event expires

However, Korean Air may retain whole or any part of PII even after its purpose has been served, if it is required by laws or applicable regulations in terms of consumer protection or if Korean Air has specified the extension of such a period as deemed necessary.
ㆍRecord of advertising and so on : 6 months
ㆍRecord of contract, agreement and regarding withdraw : five years 
ㆍRecord of consumer complaints and disputes : 3 years

4. Disclosure of "PII" 
Korean Air does not disclose PII to any third party unless it is required by laws or permitted by  the user, however, PII can be disclosed when it is necessary to provide its members with the highest-quality service. In this case, Korean Air shall notify such disclosure to an individual user via written document, e-mail, or website news specifying the purpose and contents of such information as well as its duration, and shall request for user agreement.

However, in following cases, by the terms of regarding laws, Korean Air may disclose PII without users’ permission.
Ⅰ. If required by laws or requested by the investigating government agencies
Ⅱ. If required and necessary to provide members with better service
Ⅲ. For statistics, academic research or market research provided with a personally unidentifiable form

5. Entrusting "PII"
Korean Air entrusts PII to the following companies in compliance with contracts in order to provide users with stable web services and manage cargo homepage. 
- Entrustment companies : IBM Korea, Hanjin Information System & Telecommunication Co., Ltd., Hangil Information & Technology Co., Ltd. 
- Entrustment details : Web server and database outsourcing for online service, website management program and outsourcing
Korean Air shall not entrust outsourcing companies with PII except the above-mentioned companies, unless agreed by the user. If necessary, Korean Air will notify users of the outsourcing details and receive user agreement in advance.
